United States—China Intellectual Property Relations: From Adversaries to Partners

During the last decade, the United States has repeatedly threatened China with a series of economic sanctions, trade wars, non-renewal of Most Favored Nations status, and opposition to entry into the World Trade Organization. Such threats eventually led to compromises by the Chinese government and the signing of intellectual property agreements in 1992, 1995, and 1996. Despite these measures, intellectual property piracy remains rampant in China. Every year, the United States has continued to lose $2 billion of revenues due to intellectual property piracy in China. In April, 2007, the United States filed two intellectual property grievances against China before the World Trade Organization. Will this latest procedure before the WTO solve what has heretofore an unbridgeable divide between the U.S. and China? Judging from the past, one can justifiably view this latest attempt with skepticism.
In reality, this bilateral policy as largely been ineffective, if not counter productive, and has created hostility among the Chinese people. How can this cycle of threats and counter-threats be broken? In my talk, I will propose a change in this adversarial climate to one of partnership that would focus on three remedial areas. The first is a measured increase in enforcement of China’s intellectual property laws. Second, China must engage in a concerted attempt to educate public about the meaning and benefits of intellectual property protection. Third, the U.S. business community should provide affordable alternatives for a public that wants and needs intellectual products at a reasonable price. These measures will take time to institute and to modify attitudes and behavior within Chinese society. But only within this climate of partnership and cooperation will mutually satisfactory change take place.
